ADA Lawsuit Abuse Event a Success!

ada collageThis week, LRANY co-hosted an event with the New York State Restaurant Association in New York City focusing on ADA Lawsuit Abuse. There is growing issue of serial litigants taking advantage of the Americans with Disabilities Act (ADA) to force small businesses into a settlement. Often New York small businesses are sued by plaintiffs alleging their business is not ADA compliant, some plaintiffs have even sued 8 or 9 businesses in a single day. The goal of the ADA is to provide access to people with disabilities, not to profit trial lawyers.

Our event produced an industry expert panel, consisting of defense attorney – Joesph Lynett of Jackson Lewis, ADA building designer & consultant – John Salmen of Universal Designers & Consultants, Inc., and restaurant owner and ADA lawsuit victim – Jeremy Wladis of The Restaurant Group. The event brought together dozens of business owners and interested parties who received important and educational information on what the state of this issue is and how ti mitigate risk for their business.

THANKS FOR MAKING SCAFFOLD LAW REFORM DAY AT THE CAPITOL A SUCCESS!

SLR LOBBY DAY 2016 -4Yesterday, over one hundred advocates gathered at the state capitol to urge lawmakers to support common sense reform to the New York’s Scaffold Law. Among them were contractors, builders, small business owners, developers, lawyers, and municipal officials. Attendees traveled from all corners of the state, from Buffalo to Brooklyn, to make their voice heard. The feedback from attendees on legislative meetings was overwhelmingly positive.

During the morning briefing, attendees were addressed by Judith Nelson, President & CEO of Habitat for Humanity New York State, as well as Jolie Milstein, President & CEO of the New York State Association for Affordable Housing (NYSAFAH)  – both of whom stressed the importance of Scaffold Law reform for affordable housing and disaster relief efforts. Senator Patrick Gallivan (R, Elma), who has been a champion of Scaffold Law reform since taking office in 2011, also addressed the crowd – applauding the coalitions efforts and giving them credit for the continuing progress towards change of the outdated law over the past few years.

After the morning session attendees split up into regional groups to share their stories with their legislators and educate them on the issue. Many lawmakers, expressed support for reform, and those opposed to change heard loud and clear from our supporters about why the Scaffold Law needs to be changed.

We are very excited to announce Philip K. Howard, one of America’s most acclaimed advocates for legal reform, will be featured as the keynote speaker at the Lawsuit Reform Alliance of New York’s 2015 Annual Meeting in Saratoga Springs, NY on November 12, 2015.

The best-selling author’s most recent book, The Rule of Nobody (April 2014), has been dubbed “an utterly compelling and persuasive book that, if followed, could change the way America works,” by CNN’s Fareed Zakaria. Howard has also authored numerous other books: The Death of Common Sense (1995), TheCollapse of the Common Good (2002), and Life Without Lawyers (2009).

Howard, a New York City resident who writes periodically for the Wall Street Journal, the Washington Post, and the New York Times, has appeared on The Daily Show with Jon Stewart, the News Hour, Today, Good Morning America, Charlie Rose, and many other programs. Howard’s 2010 Ted Talk entitled: Four Ways to Fix a Broken Legal System, has been viewed by hundreds of thousands of people around the world.

In 2002, Howard founded Common Good, a nonpartisan organization dedicated to overhauling America’s lawsuit culture. He has advised numerous political leaders, federal agencies, and states on legal and regulatory reform issues. Howard currently serves as Senior Counsel at the law firm Covington & Burling, LLP.
