Last night, Tom Stebbins, Executive Director of the Lawsuit Reform Alliance of New York was featured on YNN’s “Capital Tonight” with Associated General Contractors of New York State President, Mike Elmendorf. In the interview with Liz Benjamin, they discussed the American Tort Reform Foundation’s recently released 2011-2012 “Judicial Hellholes” report, which ranked New York City and Albany jointly as the sixth worst “judicial hellhole” in the Nation.
During the interview, Stebbins and Elmendorf discussed several important tort reform measures which could help reverse Albany and New York City’s “hellhole” status. “Tort reform is a way that we can balance our civil justice system to really enact fairness for both parties.” said Stebbins. Recommendations included reforming the antiquated Scaffold Law, implementing comparative negligence or fair share liability, and strengthening expert witness requirements. “…right now we have all these frivolous cases coming through the system that cost everybody money and that also slows down the process of justice.” noted Stebbins while discussing the certificate of merit requirements for expert witnesses.
